Invite
Publish this page; invite first-hand accounts in communities under their rules. Use the same short questionnaire. No fake reviews, purchased claims or inferred consent.
From one file to a comparable pattern
Start with eToro (Europe) inheritance cases. Match the legal entity, request history and unresolved loss before combining anything.
Our recommended route: an Ombudsman filing for this estate, a small verified cohort, and a consumer association’s assessment of a representative action.
Prepared 29 October 2026. This is an evidence and planning brief, not a lawyer’s opinion. No lawyer has priced or accepted the case; no lawsuit or collective action has been filed.
First / a usable case-gathering method
Those are proposed pilot targets, not statutory minimums or evidence that other cases already exist. We currently count 1 reviewed family file, not an established multi-family pattern.
Publish this page; invite first-hand accounts in communities under their rules. Use the same short questionnaire. No fake reviews, purchased claims or inferred consent.
Capture platform legal entity, residence, notice date, request dates, documents supplied, stated defect, final response, balance band and outcome.
With separate permission, inspect original emails in private, verify headers and attachments, hash originals and log each change. Keep reported and verified cases separate.
Give an association 3 redacted dossiers, a comparison matrix, the disputed practice and the specific remedy requested. Ten sign-ups alone are not a court case.
This form sends nothing. No identity documents or attachments. Downloading does not join an action or instruct a lawyer.
Private fact review; sharing with a named association/lawyer; public publication of an agreed redacted account. None implies the others. Participants receive a correction/withdrawal route; legal retention needs its own basis.
Days to first list; date of receipt vs validation; requests for the same file; new reason after acknowledgement; family response gaps; resolution and costs. An unpaid account with no verified balance is not a quantified loss.
Second / separate recovery from supervision
| Route | What we seek / what it cannot promise |
|---|---|
| Financial OmbudsmanOne estate’s dispute | €20 filing fee. Eligibility and evidence reviewed. An award of monetary compensation ≤€20,000 is binding on both parties, subject to a 30-day court challenge that suspends it; above that, both must accept within 2 months. This is the award amount, not automatically the account balance. No guarantee of an award. |
| CySECSupervisory pattern | A matrix of independently verified complaints can show recurring conduct. CySEC says it does not resolve individual complaints or order individual restitution. Do not present a regulatory complaint as the payout mechanism. |
| Consumer associationSystemic practice | Ask a currently qualified entity to assess standing, affected consumers, remedy and funding. DECO and Ius Omnibus appear on Portugal’s official list; neither has accepted this case. The association controls the action. |
| Civil courtEnforceable claim | Identify claimant, defendant, forum, instrument, recoverable loss and limitation period first. The estate’s contractual recovery and succession status may involve different rules. Do not file in parallel without checking the impact on Ombudsman eligibility. |

Third / funding with explicit limits
Recommendation: start with the €20 route and a €3,000 preparation ceiling; seek an association before personally funding litigation. The figures below, except €20, are planning allocations chosen for this project. They are not market rates, court tariffs, quotes or money already committed.
Prepare a decision
€3,000
€1,500 legal merits/forum/publication review + €500 translation/document allowance + €1,000 reserve. Proposed cap, subject to written quotes, tax and scope.
Output required: correct defendant, standing, legal basis, forum, limitations, route recommendation and cost exposure. No authority to spend is implied.
One contested pilot / scenario only
€10k–€25k
Illustrative envelope: €7k–€18k representation, €1k–€3k filing/service/translation, €2k–€4k contingency.
These are unquoted assumptions, not a reliable total. VAT where applicable, enforcement, experts, appeals and opponent-cost exposure must be separately priced. Actual costs may exceed the envelope. Do not launch fundraising against it.
No fixed entry price can be stated without their agreement. Ask who funds counsel, adverse costs, appeals and any claimant contribution. Costs rules do not mean all legal work is free.
Get 2 written mandates/quotes, a merits memo and funding terms. Separate estate recovery from compensation and operating donations. Disclose conflicts and any funder return.
Use counsel + disbursements + adverse-cost cover + enforcement + tax + contingency to set a target. Stop if the budget cannot cover the written downside or the claim lacks economic merit.
Working article map / checked 29 October 2026
This is the relevant starting map, not every potentially applicable rule or a finding of breach. Counsel must check current national implementation, the account contract/instrument and the heirs’ position.
| Question / articles | Practical use and limit |

| A signature is not its photographeIDAS Regulation 910/2014 as amended, arts. 24a(1), 25(1)–(2), 32, 46 | Qualified electronic signatures have handwritten-signature effect and cross-border recognition. Validation checks the actual signed data. A photo of a signature panel is not that signed PDF; electronic form alone is not a reason to reject a document. |
| Who administers the estatePortuguese Civil Code, arts. 2079, 2088, 2089 and 2091 | Administration and asset recovery powers. Art. 2089’s debt-collection power has conditions; other estate rights may require all heirs. It is not an unconditional order to pay one personal bank account. |
| Which succession law travelsRegulation 650/2012, arts. 21, 22, 23(2)(f), 59, 62(2), 69 | Habitual residence is the starting point, subject to exceptions and any valid law choice. Administrator powers and authentic instruments travel under defined rules. A European Succession Certificate is optional. A photo is not itself the original authenticated instrument. |
| Complaint handlingRegulation 2017/565, art. 26(1), (4), (5), (7) | Effective records, prompt handling, clear replies and analysis of recurring issues. The admitted inconsistency is relevant evidence; applicability and breach still need assessment. |
| Fair treatmentMiFID II, Directive 2014/65/EU, art. 24(1) | Investment firms must act fairly and professionally in clients’ best interests. Map the estate’s standing and the relevant service before pleading a breach. |
| Why verification can be legitimateAML Directive 2015/849, arts. 13(1), 14 | Identity verification uses reliable independent sources; implementation and risk determine the check. This can justify authentication, not an automatic finding that every repeated demand or delay is justified. Check Cyprus implementation. |
| A court route is not settledBrussels I bis, Regulation 1215/2012, arts. 1(2)(f), 4, 17–19; Small Claims Regulation 861/2007, art. 2 | Forum and consumer standing need counsel. Succession exclusions matter. The €5,000 small-claims ceiling does not make an inheritance dispute automatically eligible. Classify contractual recovery versus succession first. |
| Collective standing and remediesDirective 2020/1828, arts. 2, 4, 7–10, 12, 20; Annex I | Qualified entities can seek injunctions/redress within scope. Similar facts alone do not establish eligibility. Funding conflicts and costs are regulated. This website is not a qualified entity. |
| Portugal’s collective routeDecree-Law 114-A/2023, arts. 2, 5–6, 10–12, 18 | Standing, funder independence, prior consultation for final injunctions, and costs. Individuals covered by a redress action do not bear procedural costs as parties. Verify the specific action and engagement terms. |
| Protect living family membersGDPR, arts. 5, 6, 9, 13, 17(3)(e), 28, 32; recital 27 | Minimise data; choose a lawful basis; explain retention and recipients; secure access. Legal-claim retention is not permission for public disclosure. Deceased-person exclusion does not remove living heirs’ privacy rights. |
| Public claims must be accuratePortuguese Civil Code, arts. 70, 483–484 | Personality and reputation can create liability. Publish attributed evidence, context, correction history and relevant company replies. True facts are not blanket immunity; no page is legally “un-removable”. |
| Death-record accessPortaria 265/2023, arts. 2–4 | Indefinite online access from 1 September 2023. Do not buy a new code solely because someone repeats the old six-month rule; first identify the actual failed lookup. |
For forum, also read Regulation 1215/2012; the linked Small Claims compendium includes the €5,000 amendment and the succession exclusion. EU directive provisions may need national implementing law. The legal validity and acceptance of the family’s particular documents remain disputed.
The pressure strategy / evidence → remedy → accountability
Each claim links to a dated source. Give the company’s explanation, family response gaps and unresolved questions. Preserve a correction history and record payments when they happen.
File the estate complaint within the earliest deadline. Prepare the exact failed-check questions. Do not trade away deadlines for another informal review.
Group the same legal entity and same practice. Ask the regulator to examine the documented process and the association to assess collective remedies.
Seek payment/accounting and proven loss individually; if supported, an injunction against the systemic practice. A court decides liability and compensation.
Publicity is independent of payment. No “pay or remove”, employee targeting, fabricated reviews or unsupported fraud allegation. An eventual payment changes the result; it does not erase the documented history. A substantiated correction changes the page.
